Water Withdrawal Permitting in New York

Water withdrawals in New York are regulated under New York's water withdrawal law, enacted in 2011, and the new water withdrawal regulations promulgated by the NYS Department of Environmental Conservation (DEC) on April 1, 2013. The DEC provides an overview of its water permitting program at http://www.dec.ny.gov/lands/86935.html.

The first water withdrawal permit applications under the new regulations were due June 1, 2013. As of July 1, 2015, notice of 188 applications has been given in the DEC's Environmental Notice Bulletin. The pace of permitting is picking up. About 1600 water users registered uses of greater than 100,000 gallons per day in 2012.
